Terms of Service
These Terms of Service ("Terms") govern your use of AIPhotogen. By accessing or using the service, you agree to these Terms. If you do not agree, do not use the service.
1. Eligibility and accounts
You must be at least 13 years old and legally able to agree to these Terms. If local law requires a higher age or parental permission, that requirement applies. You are responsible for activity performed through your browser session or signed-in account and for keeping access credentials secure.
2. The service
AIPhotogen provides AI-assisted image generation and editing, task history, optional gallery publishing, free daily credits, and one-time credit packs. Models, features, prices, credit costs, limits, and availability may change. AI-generated results may be incomplete, inaccurate, unexpected, or unsuitable for a particular purpose.
3. Your Content
You retain any rights you already hold in prompts, source images, and other material you submit ("Your Content"). You grant AIPhotogen and its service providers a limited, worldwide license to host, transmit, reproduce, modify, and process Your Content only as needed to operate, secure, and improve the requested service. If you choose to publish an output to the Community Gallery, you also authorize us to display and distribute that published content until you withdraw it.
You represent that you have the rights and permissions needed to submit Your Content and to request the intended processing, including any permissions relating to copyrights, trademarks, privacy, publicity, and depicted people.
4. AI-generated Outputs
Subject to applicable law and third-party model terms, you may use outputs generated for you. AIPhotogen does not promise that an output is unique, copyrightable, non-infringing, accurate, or cleared for commercial use. Similar outputs may be generated for others. You are responsible for reviewing outputs and obtaining any rights or approvals required for your intended use.
5. Acceptable use
You may not use the service to violate law or another person's rights; create or distribute child sexual abuse material or sexual content involving minors; facilitate fraud, impersonation, harassment, exploitation, or violence; bypass security or usage controls; introduce malicious code; interfere with the service; scrape it at abusive volume; resell access without permission; or submit content you do not have authority to process.
6. Credits and Payments
Free credits are promotional usage allowances that may reset, expire, or change as described in the product. Purchased credit packs are one-time purchases, not subscriptions, and currently do not expire while the service and your account remain available. Generation costs are shown in the product and deducted when a task is accepted or completed according to the applicable workflow.
Checkout is handled by Creem. Taxes, currency conversion, and payment methods may depend on your location and the checkout provider. Except where required by law or expressly stated at checkout, completed purchases are non-refundable. We may correct duplicate charges, failed tasks, refunds, chargebacks, abuse, or credit-accounting errors.
7. Privacy
Our Privacy Policy explains how we handle information. By using the service, you acknowledge that prompts, uploads, and related information may be processed by the providers described there.
8. Third-party services
The service relies on third-party authentication, AI, database, storage, payment, and hosting providers. Their services and terms may affect availability and processing. AIPhotogen is not responsible for third-party sites or services outside our control.
9. Suspension and termination
You may stop using the service at any time. We may restrict or suspend access where reasonably necessary to address abuse, security risks, nonpayment, legal requirements, or violations of these Terms. Where practical, we will take proportionate action and provide notice.
10. Disclaimers
To the maximum extent permitted by law, the service is provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
11. Limitation of liability
To the maximum extent permitted by law, AIPhotogen and its providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business opportunities arising from the service. Our aggregate liability for a claim will not exceed the amount you paid to AIPhotogen during the 12 months before the event giving rise to the claim. These limits do not apply where prohibited by law.
12. Changes
We may update these Terms to reflect service, legal, or security changes. The revised Terms will be posted here with an updated effective date. Continued use after the effective date means you accept the revised Terms.
